Can Israel invoke "right of self-defence" in the case of Gaza?

Francesca Albanese, UN Special Rapporteur on the occupied Palestinian territories, said that Israel cannot claim the right of ‘self-defence’ under international law because Gaza is a territory which it occupies.

Her comments came in a speech to the National Press Club in Canberra, Australia.

She said the UN law is clear that "right of self-defence" can only be invoked when a state is attacked by another state.

Kamala Harris in her keynote speech to the Democratic Nationa Convetion said she respects right of Israel to its right of self-defence

and went on to say Palestinians of Gaza deserve "security, dignity, freedom and self-determination."

As a lawyer, perhaps she knows that Israel's "right of self-defence" does not mean it should get international sympathy for its attacks on Gaza.
